Alejandro Fliquete Cervera Notary · Paterna

The sale of a home, premises, garage or plot of land is formalised in a public deed before a notary. The notary checks the identity of the parties, who owns the property and any charges on it, and leaves the contract ready to be registered in the Land Registry.

  1. Gather the documents and send them online: the notary’s office reviews them before the appointment.
  2. The notary’s office requests the Land Registry extract to check who owns the property and whether there are charges.
  3. The deed is prepared and the draft is sent to you to review before signing.
  4. Buyer and seller sign before the notary, and the agreed price is paid.
  5. After signing, the taxes are settled and the deed is registered.

Preguntas frecuentes

Who pays the costs of the sale?

It depends on what the parties agree and on the law. In general the buyer pays the purchase tax (transfer tax on a resale home; VAT and stamp duty on a new build) and the seller pays the municipal capital gains tax. Notary and Registry fees follow an official scale and the notary’s office will give you a quote.

What documents do I need to buy or sell a flat?

The usual ones are the ID or NIE of everyone involved, the seller’s title deed, the latest property tax receipt and the energy efficiency certificate. The list on this page is the one the notary’s office asks for, and they will tell you if your case needs anything else.

How long does it take for the deed to be ready?

It depends on the documents and on the notary’s diary. The sooner you send the documents, the sooner the signing date can be set.

Do I have to go to the notary’s office to sign?

Yes, the deed is signed before a notary. If you cannot attend, someone else can sign for you with a sufficient power of attorney.
