Alejandro Fliquete Cervera Notary · Paterna

Giving away a home or other property requires a public deed before a notary. A gift of money should also be put in a deed, to make clear it is not a loan and to declare it properly to the tax authorities.

Para empezar, tenga a mano:

  • DNI o NIE de todos los intervinientes
  • Escritura del inmueble o justificante del dinero

Puede adjuntarlos en el encargo online o aportarlos más adelante.

Cómo funciona

  1. Send the details of the giver and the recipient, and the documents for the asset.
  2. The notary’s office checks the ownership and charges on the asset and prepares the deed.
  3. Both parties sign before the notary.
  4. Afterwards the taxes are settled and, if it is a property, it is registered in the Land Registry.

Preguntas frecuentes

Are taxes paid on a gift?

Yes. The person receiving the gift pays the Inheritance and Gift Tax, which varies by region and family relationship. If a property is given, municipal capital gains tax may also apply.

Can a gift be undone?

Only in specific cases set by law or if a reversion clause was agreed. Think it over carefully and talk to the notary’s office first.

Does it affect the inheritance of my other children?

Gifts can be taken into account when the estate is shared out. It is worth discussing it with the notary’s office before signing.

Is a deed needed to give money?

It is not compulsory, but it is recommended so that the origin of the money is clear and the tax can be filed correctly.
