Alejandro Fliquete Cervera Notary · Paterna
To share out the assets of a deceased relative, the inheritance must be formalised in a public deed before a notary. If there is a will, it is followed; if there is none, the notary can process the declaration of heirs.
- Send the death certificate and the certificate of last wills, the will if there is one, and the details of the heirs and the assets.
- The notary’s office checks the will (or, if there is none, processes the declaration of heirs) and prepares the inventory of assets.
- The heirs agree on how to share it out and the deed of acceptance and allocation of the inheritance is prepared.
- All the heirs sign before the notary.
- After signing, the inheritance taxes are settled and the assets are registered in the heirs’ names.
Preguntas frecuentes
What documents do I need for an inheritance?
The usual ones are the death certificate, the certificate of last wills, the will if there is one, the family record book or a document proving the relationship, the heirs’ ID and the documents for the assets. The list on this page is the one the notary’s office asks for.
Is there a deadline to accept the inheritance?
To pay inheritance tax, the general deadline is six months from the death, although it depends on each region and can be extended. It is best to start as soon as possible.
What happens if there is no will?
The heirs are determined by law. The notary processes the declaration of heirs, which establishes who they are and in what proportion they inherit.
Do all the heirs have to be present?
All of them must take part, in person or with a power of attorney so that someone else can represent them. If one lives far away, ask about that option.
