In Spain the marriage file can be processed and the wedding held before a notary. Marriage settlements (capitulaciones), which set the financial regime of the marriage (for example, separate property), are also signed before a notary, before or after the wedding.

Para empezar, tenga a mano:

  • DNI, NIE o pasaporte de ambas personas
  • Capitulaciones o documento anterior, si existe · Si procede

Cómo funciona

  1. Tell us what you need (wedding, settlement or civil partnership) and send the details of both of you.
  2. The notary’s office tells you which documents to provide and, for a wedding, handles the prior marriage file.
  3. Both of you sign before the notary, together and in person.
  4. The notary’s office notifies the Civil Registry so that the marriage or settlement is registered.

Preguntas frecuentes

Can I get married before a notary?

Yes. The notary handles the marriage file, which checks that there are no impediments, and then authorises the wedding. Two adult witnesses are required.

What is a marriage settlement?

A deed in which the couple chooses or changes the financial regime of the marriage, for example moving from community property to separate property. It can be signed before or after the wedding.

What about civil partnerships?

It depends on the region: in some, a deed before a notary serves to prove the partnership or register it. The notary’s office will explain how it works in yours.

Can it be done by video call?

No. The wedding and settlements are signed in person at the notary’s office; everything before that (details, documents and questions) is prepared remotely.
