Alejandro Fliquete Cervera Notary · Paterna

An open will is made before a notary, who checks that the person has capacity and is expressing their wishes freely. It is recorded in the General Register of Last Wills and can be changed whenever you like by making a new one.

Para empezar, tenga a mano:

  • DNI o NIE en vigor

Puede adjuntarlos en el encargo online o aportarlos más adelante.

Cómo funciona

  1. Send your ID and the details of the people you want to name as heirs.
  2. The notary’s office meets you, explains the options and drafts the will according to your wishes.
  3. Read the draft calmly: the notary reads it out and explains it to you before you sign.
  4. You sign before the notary. You are given a copy and the notary notifies the Register of Last Wills.

Preguntas frecuentes

How much does it cost to make a will?

The notary’s fees follow an official scale and the notary’s office will give you a quote. Making a will does not itself trigger any tax.

Can I change or cancel it?

Yes, as long as you keep your capacity. You do it by making a new will: the last one you sign is the one that counts.

Do I have to leave part of my estate to my children?

In most territories the law reserves part of the estate for children and other forced heirs, known as the “legítima”. The rules depend on the region and the notary’s office will advise you.

What happens if I do not make a will?

The estate is shared out according to the law, which may not match what you would have wanted.
